Fabydo Limited

The following Terms and Conditions refer to the Fabydo Limited website. Please do not place an order if you do not agree with any part of these Terms and Conditions. Fabydo Limited reserve the right to modify or update these Terms and Conditions at any time. These conditions of sale apply to the agreement between Fabydo and the customer.

Definitions

“Conditions of Sale” means these Terms and Conditions of sale;

“Consumer”, “customer”, “you”, is a person who is defined as a Consumer for the purposes of the Distance Selling Regulations.

“Us” and “we” means Fabydo Limited.

“Fabydo”, “Fabydo Limited”, “Fabydo.co.uk”, “Fabydo.com” is the Company registered as Fabydo Limited, Company no. SC433195. Address 26 Kettil’stoun Crescent, Linlithgow, West Lothian, EH49 6PR, Scotland. Telephone number 078 1000 2764. Email info@fabydo.com.

“Product” means any products displayed for purchase on the Fabydo website.

“Terms of Use” means the terms governing your use of this Website displayed on the Website;

“Website” means the website located at fabydo.com and fabydo.co.uk.

“Working day” means a day other than a Saturday or Sunday and bank holidays.

 

1. Orders

By placing an order you are confirming that you have read and agree to be bound by Fabydo Limted Terms and Conditions. All orders are subject to acceptance by Fabydo.

Once you have placed and paid for an order you will receive a confirmation email to the email address you have stated confirming your order number and ordered items.

Acceptance of your order by Fabydo is subject to these Terms and Conditions and to the availability of stock. Fabydo reserves the right to withdraw or cease selling any product from/on the website at anytime, and may, in its sole discretion, refuse to process an order for any reason at any time. Without prejudice to your statutory rights as a consumer, Fabydo will not be liable to you, or a third party by reason of Fabydo withdrawing any goods/ products or refusing to process any order.

2. Price and Payment

All prices are in £ sterling. Prices are detailed on the product page.  Payment may be made via a PayPal account or via PayPal using a credit or debit card accepted on the PayPal website. Fabydo reserves the right to refuse an order or payment in its reasonable discretion.

3. Description of Products

All products for sale on the website are made to order to maintain freshness. Due to the soap making process and the nature of soap no two soaps are exactly identical. All products are produced to the same high standard but slight colour or pattern variations may occur. The photographs depicted on the site are as accurate as reproduction and image processing will allow.  Fabydo accepts no responsibility for slight variances in colour and style.

These are fun soaps and are not toys.

4. Cancellations and Returns

In the unlikely event that you do not receive the product you ordered please contact us within 2 days of receiving your order to advise us of the error and Fabydo Ltd will refund the cost of your order.

Where personalised products are concerned, unless there has been an error on our part, or the item you purchased is defective, we cannot accept returns on these items.

Due to the nature of the product, we do not accept returns for items as a result of a change of mind.

5. Defective items

All products are quality checked before they leave Fabydo, however, in the unlikely event that your product is defective please contact us within 2 days of receiving your order. You will be given a returns number. Please quote the returns number on the outside of your package and then return the item to us within 7 days and we will refund the cost you paid for your item including shipping, together with your return postage costs (within reason). The refund will be processed within 14 days of receiving the returned items and will be made in the same form used to make your initial payment.

6. Your right to cancel

In accordance with the Long Distance Selling Regulations you, as a consumer, have a right to change your mind and cancel the order at any time up to the expiry of seven working days after you receive the delivery of the goods. If you wish to cancel you must notify Fabydo in writing or by email within this period of time. You must take reasonable care of the products and they will be returned to us at your cost. We will only accept returns for products whose packaging is unopened. If the packaging of the individual product has been opened, you lose the right to cancel at that moment because it is no longer possible for us to accept the product back and resell it.

The right to change your mind applies only to those products that have not been created specifically for you such as personalised or bespoke orders. For products that fall within those terms your right to cancel will cease when we start work on your order.

Item(s) returned for reasons not due to our error or defective product(s) will not have return shipping costs refunded. We will try to carry out our responsibilities under this agreement within 30 days of your order, or we will notify you and refund you within 60 days. Your statutory rights are not affected by any of the terms above.

7. Returned item(s)

It is the responsibility of the customer to ensure the safe return of any items. Fabydo cannot be held responsible for packages lost in transit. It is therefore, recommended that returned items are sent by Royal Mail Recorded or Special Delivery.

8. Delivery

Products will be shipped by Fabydo using First Class Royal Mail service. The shipping cost will be dependant on the value of the order in accordance with the delivery cost table. Orders should be received within one to two working days from date of despatch in accordance with Royal Mail’s delivery timescales for first class deliveries. Despatch will usually be made within 5 working days of receiving your order. Fabydo will not be held responsible for any issues within the delivery company affecting the delivery of your goods.

Where an incorrect delivery address has been entered with your order resulting in the goods being returned to Fabydo, we will refund to you the sales value of the goods less the sum of the outward shipping cost and any cost incurred in the return of the goods to us by the carrier.

9. Liability

Unless otherwise agreed in writing, Fabydo Limited maximum liability to you arising by reason of or in connection with the supply of the products to you shall be limited to the amount paid by you in respect of the products in question. Fabydo shall not in any event be liable to you for:

1. any direct loss in excess of the payment amount; or

2. any loss of profits, business or anticipated savings or loss of or corruption to data or any other indirect loss or consequential loss whatsoever even if it has been advised of the possibility of such loss. This does not affect your statutory rights as a consumer.

Soap ingredients are listed for each Fabydo product to allow the customer to ensure that the soap is suited to them. Soaps purchased from the Fabydo website should be able to be enjoyed by the majority, however, in the unlikely event that a soap is unsuitable for your skin type Fabydo accepts no responsibility or liability for this.

11. Force majeure

Fabydo Limited shall have no liability to you for any delay or failure to deliver the products to the extent that such delay or failure to deliver arises from causes beyond the reasonable control of Fabydo including, but not limited to, fire, floods, acts of God, acts or regulations of any governmental or supranational authority, war, riot, strike, lock-out and industrial disputes.

12. Entire agreement

These Terms and Conditions, together with the Delivery and Returns Policy, current Product Prices, Delivery Details, Privacy Policy and Contact Details on this website, set out the agreement between you and Fabydo. Fabydo employees or agents are not authorised to make any representations concerning the products unless confirmed in writing by Fabydo.

You confirm that you do not rely on, and waive any claims for breach of, any such representations, which are not so confirmed.

13. Third party rights

A person who is not a party to the contract governed by these Terms & Conditions has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of these Conditions of Sale.

14. Governing law

These Terms and Conditions shall be exclusively governed by and construed in accordance with the laws of Scotland and you irrevocably submit to the exclusive jurisdiction of the courts of Scotland.
